By tendering materials for shipment via any of OCS services, the shipper agrees to the terms and conditions stated herein and to reference and which are available from or for inspection at OCS office. No agent, franchisee and employee of OCS; or the shipper may alter or modify these terms and conditions:

  1. THE CONSIGNMENT NOTE
  2. This OCS Consignment Note is non-negotiable and the shipper acknowledges that it has been prepared by the shipper or by OCS on behalf of shipper. The shipper warrants that s/he is the owner of the goods transported here under or s/he is the authorized agent of the owner of the goods and that s/he hereby accepts OCS terms & conditions for him/herself and as agent for and on behalf of any other person having any interest in the shipment

  3. SHIPPERS OBLIGATIONS AND ACKNOWLEDGEMENTS
  4. The shipper warrants that each article in the shipment is properly described on this Consignment Note and has not been declared by OCS to be unacceptable for transportation and that the shipment is properly marked and addressed and packed to ensure safe transportation with ordinary care in handling The shipper hereby acknowledges that OCS may abandon and/or release any item consigned by the shipper to OCS which OCS has declared to be unacceptable as determined under section 11 hereof or misdescribed herein whether intentionally or otherwise without incurring any liability whatsoever to the shipper and the shipper will save and defend indemnity and hold OCS harmless from all claims, fines and expenses arising there form. The shipper shall be liable for all cost and expenses related to the shipment and for cost incurred in either returning the shipment to the shipper or warehousing the shipment pending disposition

  5. RIGHT OF INSPECTION OF SHIPMENT
  6. OCS has the right but not the obligation to inspect any shipment including, without limitation, opening the shipment

  7. LIEN ON GOODS SHIPPED
  8. OCS shall have lien on any goods shipped, for all freight charges, octroi, duties, advances or other charges of any kind arising out of the transportation here under and may refuse to surrender possession of the goods until such charges are paid

  9. LIMITATION OF LIABILITY
  10. The liability of OCS for any loss or damage to the shipment which (term shall include all documents and/or any article entrusted to OCS for any carriage and delivery under a valid consignment note) is limited to:

    1. A sum of Rs 100/= (Rupees one hundred only)
    2. The value of Documents and/or articles dispatched through OCS is in the opinion of the consignor valued over Rs 100/-, the same shall be mentioned in the consignment note and it shall be necessary for the consignor to obtain insurance for the same from OCS or any insurance company. Otherwise the liability of OCS would be limited to the extent of a sum of Rs. 100 (Rupees one hundred only)
  11. ACTUAL VALUE
    1. The actual value of document (which term shall include any item of no commercial value which is transported hereunder) shall be ascertained by reference to its cost or preparation or replacement, reconstruction of reconstitution value at the time and place of shipment which ever is less
    2. The actual value of a parcel (which term shall include any item of commercial value which is transported hereunder) shall be ascertained by reference to its cost of repair or replacement resale or fair market value at the time and place of shipment whichever is less in no event shall such value exceed the original cost of the article actually paid by the shipper plus 10%
  12. CONSEQUENTIAL DAMAGES EXCLUDED
  13. OCS shall not be liable in any event for any consequential or special damages or other indirect loss, however arising whether or not OCS had knowledge that such damages might be incurred including but not limited to loss of income, profits, interest, utility or loss of market.

  14. LIABILITIES NOT ASSUMED
  15. While OCS will endeavor to exercise its best efforts to provide expeditious delivery in accordance with regular delivery schedule. OCS will not under any circumstances be liable for delay in pickup, transportation or delivery or any shipment regardless of the cause of such delay. Further OCS shall not be liable for any loss, damage, misdelivery or non-delivery.

    1. Due to act of God, force majeure, accruance of any cause reasonably beyond the control of OCS
    2. or caused by
      1. the act, default or omission of shipper, the consignee or any other party who claims an interest in the shipment (including violation or any term or condition hereof) or of any person other than OCS or of any government officials of the postal service forwarded or another entity or person to whom a shipment is tended by OCS for transportation to any location not regularly served by OCS regardless of whether the Shipper report do had knowledge of such third-party delivery arrangements
      2. The nature of the shipment for any defect, characteristic or inherent vice thereof
      3. Electrical or magnetic injury, erasure or other such damage to electronic or photographic images or recording in any form
  16. CLAIM
    1. Any claim must be brought by the shipper and delivered in writing to the office of OCS nearest to the location at which the shipment was accepted within 15 days of the date of such acceptance. No claim may be made against OCS outside of that time limit
    2. No claim for loss or damage will be entertained until all transportation charges have been paid. The amount of any such claim may not be deducted from any transportation charges owned to OCS
    3. KARACHI court alone shall have the exclusive jurisdiction to entertain, try and adjudicate suits arising out of OCS Consignment Note/ service/ compensation claim
  17. APPLICABILITY
  18. These terms and conditions shall apply to and incur to and the behalf of OCS Pakistan (Pvt.) Ltd. and its authorized and affiliated companies and their officers, directors an employees

  19. MATERIALS NOT ACCEPTABLE FOR TRANSPORTATION
  20. OCS will not carry Currency, Jewelry, Bullion, Antiques, Liquor, Stamps, Precious metals, Fire arms, Plants, Drugs, Work of Arts, Precious Stones, Explosives, Animals, Perishables, Negotiable instruments in bearer forms, Currency, Obscene or Pornographic materials,  Industrial Carbons, Diamonds, IATA restricted articles including hazardous combustible material property, the carriage of which is prohibited by any law, regulation or statute of any provincial or federal government of Pakistan & Mail/Parcels on P.O. Box Addresses. IN COMPLIANCE WITH PAKISTAN POST OFFICE ACT-1898, OCS WOULD NOT ACCEPT LETTERS OR POST CARDS AS THEIR CARRIAGE IS THE EXCLUSIVE PRIVILEGE OF THE FEDERAL GOVERNMENT

  21. INSURANCE
    1. At the request of the shipper and upon payment thereof OCS will arrange insurance on behalf of the shipper
    2. The insurance coverage shall be governed by all the terms and conditions contained in the policy of insurance issued by the insurance company
    3. CONSEQUENTIAL DAMAGES AND LOSS OR DAMAGE RESULTING FROM THE DELAYS OR TRANSPORTATION ARE NOT COVERED BY ANY SUCH POLICY OF INSURANCE

PRINTED MATTE HANDLING CALUSE AND CONDITIONS OF CARRIAGE By the condition set out below, OCS Pakistan (Pvt.) Ltd. will not be liable for certain losses and damage and secondly, if they are to be liable the amount of liability as in all circumstances, limited to the amount stated therein above. Customers are hence advised to seek their own insurance cover in areas in which liability and fault are not clearly accepted by OCS Pakistan (Pvt.) Ltd.

  1. The forwarding that OCS Pakistan agrees to be commissioned with shall be defined as affairs itemized hereunder that are involved when a customer uses OCS Pakistan to send them from this country to one of more other countries. Printed matter means all business related document but having no commercial value which includes Banking and shipping document, engineering and construction plans, specification and report, invoice and orders, audit and accounting data, insurance papers legal documents and general interoffice business paper but excluding anything that falls under the category of private correspondence, currency cheques and other valuables
  2. OCS Pakistan shall not undertake with forwarding of anything other than the printed matter and OCS Pakistan reserves the right to inspect anytime the documents consigned by its customer to ensure that all documents or particulars are in order as per clause I above in case that printed matter consignment should have missed anything other than the specifies printed matter, OCS Pakistan shall be neither responsible not liable in any way.
  3. OCS Pakistan undertakes to carry the customer documents as per separate tariff which is subject to alterations due to possible airfreight revision monetary and economic fluctuations
  4. A contract of forwarding service shall be sought when a customer fills out “Manifest of Consignment Note” (hereafter called invoice) declining he consignee’s name and address, description of article etc which shall be effected when OCS Pakistan put a signature or seal on part of the said invoice and return its one copy t he customer as an evidence of acceptance
  5. OCS Pakistan will not be imposed or loss incurred due to the customers document being impounded by the customs or similar authorities and the customer hereby indemnifies OCS Pakistan for any such penalty or loss. OCS Pakistan accepts no responsibility or incorrect packaging or damage to documents or goods consigned unless such damage can be proven to have arisen through the gross negligence of OCS Pakistan. It is the sole responsibility of the customer to address adequately each consignment of document to enable effective delivery OCS Pakistan shall not be liable for delay in delivery of forwarding resulting from the customer failure to comply with its obligation in this respect.
  6. OCS Pakistan shall try its utmost to perform the service speedily with particular attention as under:
    1. Care shall be taken to safeguard consignments from such accidents as damage, theft and non-delivery
    2. In case that any unpredictable incidents should happen during the process of forwarding services, the customer concerned shall be so informed immediately and appropriate remedial measure shall be taken as required
    3. When any part of forwarding services is performed inside the office of the customer concerned the customers instructions shall be fully respected
    4. Care shall be taken to observe the relevant laws of the nations convened and never to violate any of them
    5. Care shall be taken no to disclose any of the contents of printed matter consigned or of the customers business or technical secrets that are made known during the performance of forwarding service or any information that may counter to the customers interests
  7. OCS Pakistan shall only come under obligation to compensate for damages in case the printed matter consigned should be damaged, destroyed or lost because of such reach attributed to OCS Pakistan, but otherwise shall not be responsible for such damages even if the customer concerned should suffer any loss in either case the customer shall pay the forwarding service fee as contracted in case that OCS Pakistan should be found liable to damages. OCS Pakistan shall make compensation to the following limit provided a compensation claim is lodged with OCS Pakistan (Pvt.) Ltd. not later than 15 days from the date of use if the CWB, after which  no claim would be entertained:
    1. If a copy identical to the printed matter damaged, destroyed or lost is available in the market an amount equivalent to its market price shall be paid but to the limit of sum not exceeding Rupees FIFTEEN HUNDRED
    2. If a copy identical to the printed matter damaged destroyed of list in not available in the market but can be obtained by reprographic means an amount equivalent to the expenses required in its production shall be paid but to the limit of sun not exceeding Rupees FIFTEEN  HUNDRED
    3. If the customer concerned wishes to re-ship substitute copies for the printed matter damaged destroyed or lost OCS Pakistan shall be willing to perform forwarding service free of charge.
  8. In case of breach of contract or a false statement made to OCS Pakistan on the part of the customer concerned OCS Pakistan shall be entitled to be released from the said contract ay any time sand thus OCS Pakistan shall be entitled to claim from the customer concerned the entire damages involved.
  9. In case dispute shall arise over a contract of forwarding services the jurisdiction over it shall being to Karachi district court
Wherever OCS Pakistan (Pvt.) Ltd. appears in the document then expression shall also include OCS Road & Rail (Pvt.) Ltd. OCS Pakistan (Pvt.) Ltd. and OCS Road & Rail (Pvt.) Ltd. incorporated in Pakistan under Companies Ordinance 1984
